The battle over tougher abortion restrictions in Texas resumes Monday--with arguments set before the 5th Circuit Court of Appeals in New Orleans.
For backers of the restrictions--including the Justice Foundation's Allen Parker--the requirements--which include doctors who perform the procedure to have admitting privledges at a nearby hospital--only make sense.
"The abortion industry has fought every reasonable regulation that has ever been passed against it in one form or another" Parker told 550 KTSA News.
However, critics insisted the law only puts undue barriers in front of a woman's right to choose the procedure. While she does feel that argument is on solid legal ground, Patricia Rodriguez with Planned Parenthood told 550 KTSA News she's not holding out much hope for action stemming from this hearing.
"I'm ever hopeful--but I'm also realistic. The 5th Circuit has not sided with us before--and I doubt they'll side with us on this" Rodriguez said, adding the issue may ultimately have to go all the way to the United States Supreme Court before it can be finally resolved.
