Jude Says No to Hasan Strategy

A military judge has ruled against allowing admitted Fort Hood shooter Major Nidal Hasan to tell jurors at his court martial that he opened fire to protect Taliban leaders in Afghanistan. 

In her ruling, Colonel Tara Osborn said that "defense of others" strategy fails as a matter of law, adding no soldiers at the post were an immediate threat to anyone in Afghanistan. 

The judge also ruled the legitimacy of the war in Afghanistan is not an issue at Hasan's trial--which has not yet begun in the aftermath of the November 5, 2009 shooting rampage which killed 13 people. 

If conviceted, Hasan faces the possibility of a death sentence, or life behind bars without the possibility of parole.
