By Bill O'Neil Another legal move has been made int he fight between a teen and the Northside Independent School District over a student id program. Lawyers for 15 year old Andrea Hernandez are asking the Fifth Circuit Court of Appeals to step in--and allow the John Jay High School student to remainin her magnet program there until a final ruling is made on her appeal.
"We don't think she should be moved. We think it's unfair. We think there are important constitutional issues here that were not properly viewed in the court below" said Rutherford Institute President John Whitehead.
Lawyers for Hernandez filed an appeal earlier in the week--after a lower court judge ruled the District had made an acceptable accomodation for Hernandez--who would be required to wear a student ID badge--minus a locator chip. She has objected to the program citing religious reasons.
