A John Jay High School student who refuses to wear a radio frequency identification badge won't be able to stay at the magnet school.
Fifteen-year-old Andrea Hernandez will have to clean out her locker Tuesday as she transfers to her home campus at Taft High School, which does not have the microchip-embedded student ID badge. .
Attorney John Whitehead with the Rutherford Institute says the Northside School District notified them about the decision after an appeals court ruled that Hernandez could be removed from the school.
"She's ready to keep going and fighting and her family's united. We're going to keep going, I mean, this is something that's spreading across the country," said Whitehead.
Northside School District officials offered to allow Hernandez to wear the student ID badge without the tracking chip, but she refused, citing religious reasons.
She and her family believe the badge is a "mark of the beast."
"We're going to continue with our court case and hopefully the 5th Circuit Court of Appeals will make a better decision and maybe the U.S. Supreme Court will get involved as well," said Whitehead.
