By Elizabeth RuizA Municipal Court Judge has postponed hundreds of cases against the president of Bexar Towing and the founder of the company.
They're accused of charging owners of illegally parked cars more than the city ordinance allowed at the time for a nonconsent tow.
Judge Robert Lipo decided Tuesday to delay the cases until legal challenges are resolved.
"The issue is whether the ordinance was enforceable in the first place," said attorney Mark Canaan, who represents Bexar Towing founder John DeLoach.
At the time that DeLoach was cited, the city's cap for nonconsent tows was $85 , which is far lower than state's limit of $250. That's what DeLoach was allegedly charging.
"So if we're successful asserting that issue and the ordinance is found to be unenforceable, that would affect all cases," said Canaan.
By all cases, he means 7 against DeLoach and more than 400 against Bexar Towing president Alex Garcia.
Last week, city council agreed to increase the cap for nonconsent tows to $177. That ordinance goes into effect this weekend.
