Trial Delayed After Murder of Witness

A murder trial has been postponed after a key witness for the state was gunned down outside her West Side home.

Jury selection in the trial of 44-year-old Martin Balboa was scheduled to begin Tuesday, but First Assistant District Attorney Cliff Herberg told 550 KTSA News prosecutors asked for a continuance.

"The court granted a continuance to give us time to review the case and obtain evidence from other sources that's necessary to proceed with the case," said Herberg.

Balboa's ex-girlfriend, a witness in the murder case against him, was shot and killed Sunday morning in front of her home on Brownleaf Drive.  Two teenage sons were sitting in the truck, waiting to go to church,  when 44-year-old Julie Rodriguez was shot several times by a gunman who fled in a gray car.

While not elaborating on Rodriguez' impending testimony, Herberg told 550 KTSA News she was a key witness.

"We're going to review the case and see if we can get evidence from other sources that will replace the testimony that Ms. Rodriguez was going to provide," said Herberg.

Balboa is out on bond, awaiting trial.   He's accused of being the getaway driver when 27-year-old Joseph Delgado was shot several times while playing basketball outside a community center in the South Side.
