They can't legally get married in Texas--but the State Suprme Court will decide whether or not same sex couples can legally be divorced in the Lone Star State after hearing arguments Tuesday.
Critics will tell you the case should never have been allowed to go this far.
"The law is very clear on this--the precedent in the State of Texas is very clear--that marriage is defined as between one man and one woman" said Jonathan Saenz with Texas Values. He told 550 KTSA News the case is nothing more than an end around attempt at state law--an effort to force the state to recognize same sex marriage.
"This is an easy opportunity for the nine Republican justices of the Supreme Court to make it clear that our constitution stans for marriage between one man and one woman--and we also don't allow same sex divorce" Saenz said.
