Paxton: Fantasy Sports Illegal in TX

Attorney General Ken Paxton rules daily fantasy sports are “prohibited gambling in Texas.”

“Paid daily ‘fantasy sports’ operators claim they can legally operate as an unregulated house, but none of their arguments square with existing Texas law,” AG Paxton said. “Simply put, it is prohibited gambling in Texas if you bet on the performance of a participant in a sporting event and the house takes a cut.”

Paxton released his non-binding opinion Tuesday.

He wrote, under Texas law, “partial chance” is considered gambling, unlike in other states.

Traditional fantasy sports are still legal in Texas because in those leagues there’s no house that takes a cut and the participants split the money.
