SAN ANTONIO (KTSA News) — A wrongful death lawsuit has been filed against a DPS Trooper by the family of a man who was shot after a high speed chase.

KSAT 12 reports the shooting happened April 29.

It began in New Braunfels when Trooper Apolonio Gomez attempted to stop a vehicle driven by 37-year-old Luis Navarro.

Navarro reportedly refused to stop and led the trooper on a chase that ended when Navarro crashed in Converse.

Navarro got out of his car but refused to follow the trooper’s commands and was tased. But when the taser had no impact on Navarro, Trooper Gomez pulled his gun and shot him.

KSAT’s report says Navarro’s family is looking for compensation for attorney’s fees, funeral expenses and mental anguish.

Trooper Gomez is a 7-year DPS veteran and is the only defendant named in the lawsuit.

He has not been charged in the shooting.
